well, of course it is not allowed to use ripped graphics (like Zelda-, Sonic- or Super Mario-sprites) in a game which is meant to be sold.

but how is it with homebrewed games? tiny little hobby productions, never meant to make profit? i think it is forbidden, too, since it is copyrighted material. but i also think that there is little risk for the homebrewer using the graphics, because the big companies mostly don

I believe I have hosted such projects in the past.  And as long as one doesn't claim that copyrighted work is their own (if proper credit is given) I'll do so in the future unless I discover any threat/problem to doing so.  There are "fair use" laws that allow for use of copyrighted works in some cases: http://en.wikipedia.org/wiki/Fair_use.  I'm not sure that this would qualify, but I think in the cases we would see with SGDK games, it would be safe to at least host such games until the copyright holder requests it's removal.

Edit: And SGDK project using copyrighted artwork might be considered fan art.

Kind of funny you should mention those three. Since BlueMonk has posted a game based with graphics from Zelda, Sonic, and Mario.

As long as you don't gain profit, the companies are happy.
